Terms of Service - Illustration service

OVERVIEW
This website and services are operated by MysticScribbles. Throughout the site, the terms "Artist," "we," "us," or "our" refer to MysticScribbles or Ashley Osayande. By commissioning or purchasing artwork, you ("Client," "you") agree to these Terms.

1. Services Offered

The Artist provides custom illustration services including but not limited to:

  • Character design

  • Book or album covers

  • Portraits

  • Commercial artwork

Details of each project (e.g., size, style, number of revisions) will be agreed upon in writing before work begins.

2. Payment Terms

  • The full deposit is required before work begins.

  • It is possible to negotiate a payment plan if the full deposit can not be paid all at once.

  • All payments are processed via [e.g., PayPal or Bank Transfer].

Late Payments: Projects may be delayed or canceled if payment is not received on time.

3. Revisions

  • The commission includes 2 free revisions per stage (sketch and rendering).

  • Additional revisions may be charged at a rate of [€15 per revision].

  • Major changes requested after approval of the sketch or final stage will incur extra charges.

4. Turnaround Time

  • Typical turnaround time is 2-4 weeks but may vary based on complexity and Artist availability.

  • Rush orders may be accepted with a surcharge and must be agreed upon in advance.

5. Usage Rights & Copyright

  • The Artist retains all rights to the artwork unless a separate licensing agreement is signed.

  • Personal-use clients: You may use the artwork for personal, non-commercial purposes (e.g., profile pictures, prints for your home).

  • Commercial-use clients: Must pay a commercial license fee. Use includes advertising, merchandise, and monetized media.

Do Not:

  • Claim the artwork as your own

  • Alter or resell the artwork without permission

6. Cancellations & Refunds

  • If the client cancels before work has begun, the deposit is retained.

  • If the artist cancels, the client will receive a full refund.

  • Half the deposit will be refunded when work has begun

  • No refunds will be given after the final artwork is delivered.

7. Communication

All project-related communication will take place via [email, Discord, etc.]. Clients are expected to respond within a reasonable timeframe to avoid delays.

8. Confidentiality

The Artist agrees to keep any confidential information shared by the Client private and secure, and expects the same in return.

9. Disclaimer

The Artist is not responsible for delays due to unforeseen events (illness, emergencies, etc.), but will communicate any issues promptly.
